Procedure
The following is simply a quick summary of how the process works.
EMPLOYER - can be an Australian or *overseas business based in Australia
(1) Employer must apply to Australian Immigration on the appropriate form to be a sponsor of overseas candidates
(2) Employer supplies details of eligible position/s vacant at the same time on an Employee Nomination Form.
An eligible position must meet the following requirements:
(a) be full-time
(b) be a skilled accupation that is approved for the SOL 457 Visa program
(c) meet the minimum salary level
(d) meet all relevant Australian laws and award requirements.
In the nomination document, the employer must identify:
(e) Position/s to be filled
(f) Skills and experience required for the position/s.
Upshot
(3) Employer must act as a sponsor for employees working within the 457 visa program, which entails contributing to an improvement in skills
(4) Employer must cooperate with the Australian government's monitoring requirements
(5) Employer must meet certain costs and other obligations as part of the 457 visa program
* Overseas businesses are businesses that have no formal operating base or representation in Australia but who want to bring employees to Australia to do one of the following:
- establish a branch or other business activity such as joint ventures, agency distributorships or subsidiary branches in Australia
- fulfil obligations for a contract or other business activity in Australia.
EMPLOYEE
(1) Employee must be a foreign national
(2) Employee accepts the offer of employment from the employer
(3) Employee applies for a visa
(4) Employee meets all conditions for the granting of a 457 temporary visa
Note: The visa application must be lodged and granted before the sponsorship and nomination expires, or a new sponsorship and/or nomination will be required.
